These Terms of Service (“Terms”) govern the services provided by Ares Diesel Repair Inc. (“Company,” “we,” “our,” “us”) to its customers (“Customer,” “you,” “your”). By requesting or receiving services, you agree to these Terms.
1. Services
- We provide mobile diesel repair, diagnostics, maintenance, and related services.
- Service availability depends on technician schedules, parts availability, and location accessibility.
- We may decline service requests that pose safety risks or fall outside our expertise.
2. Customer Responsibilities
- Ensure the vehicle/equipment is safely accessible for repair and complies with site safety rules.
- Provide accurate information about the vehicle, prior repairs, and known issues.
- Comply with applicable safety and environmental regulations at the service location.
3. Payment Terms
- Rate: Services are billed at our posted or agreed rate in effect at the time of service, plus parts, supplies, shop materials, and applicable taxes. Rates may vary by customer account, service type, time of day, and location.
- Invoices: Due upon receipt unless otherwise agreed in writing.
- Late fees: 1.5% per month (or the maximum permitted by law, if lower) on past-due balances.
- Deposits: We may require a deposit for parts orders or major repairs.
- Non-payment: We may suspend service, withhold parts, or delay warranty coverage for accounts in arrears.
4. Warranties & Disclaimers
- Labor warranty: 90 days from date of service. Parts are covered only by the manufacturer’s warranty, if any.
- No guarantee of uninterrupted vehicle uptime, performance, or fitness for a particular purpose.
- Repairs are based on information available at time of service; concealed or unrelated issues may not be identified.
5. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages (including lost income, downtime, or loss of use) arising from delays, failed repairs, parts failures, or service interruptions. Our maximum liability is limited to the amount you paid for the specific service performed.
6. Cancellations & Rescheduling
- Appointments canceled with less than 24 hours’ notice may incur a service call fee equal to one hour at the posted or agreed rate.
- If we arrive and cannot perform service due to unsafe conditions, lack of access, or inaccurate information, a minimum service fee of one hour at the posted or agreed rate (plus any call-out charges) will be charged.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas.
8. Amendments
We may update these Terms from time to time. The most current version will be posted on our website or provided upon request. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
